Welcome to The Undercut. By downloading, installing, or using the App, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
1. About the App
The Undercut is a free-to-play fantasy Formula 1 game that allows users to build fantasy teams of real F1 drivers and constructors, join leagues with friends, and earn points based on real-world F1 race results. The App is not affiliated with, endorsed by, or connected to Formula 1, the FIA, or any F1 team.
2. Eligibility
You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.
3. Account Registration
You may register using an email and password, Google Sign-In, or Apple Sign-In.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You agree to provide accurate information and keep it up to date.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
Use the App for any unlawful purpose.
Attempt to gain unauthorized access to other users' accounts or our systems.
Use automated tools, bots, or scripts to interact with the App.
Exploit bugs, glitches, or vulnerabilities in the App. If you discover a bug, please report it to us.
Upload content that is offensive, abusive, hateful, or violates the rights of others.
Impersonate other users or public figures.
Interfere with or disrupt the App or its servers.
Use the App for real-money gambling or betting. The Undercut is a free-to-play fantasy game with no monetary prizes.
5. Fantasy Game Rules
Teams consist of 5 drivers and 1 constructor, selected within a budget of $1,000.
Driver and constructor prices are determined by real-world F1 performance and may change throughout the season.
Points are awarded based on real F1 race and sprint results.
Team lineups are locked before each race weekend. You cannot modify your team during a lockout period.
We reserve the right to adjust scoring rules, prices, and game mechanics at any time to maintain fair play.
League administrators may manage their leagues, including inviting or removing members.
6. User-Generated Content
You may create content within the App, including team names, league names, and uploaded profile images. By creating content, you:
Grant us a non-exclusive, royalty-free license to display your content within the App (e.g., showing your team name in a league leaderboard).
Represent that your content does not infringe on any third party's rights.
Acknowledge that we may remove content that violates these Terms.
7. AI-Generated Content
The App uses Google's Generative AI (Gemini) to create avatar images and summarize news articles. AI-generated content is provided "as is" and may not always be accurate or appropriate. We are not responsible for the output of AI-generated content.
8. Intellectual Property
The App, its design, code, and original content are owned by The Undercut and protected by applicable intellectual property laws.
Formula 1, F1, and related marks are trademarks of Formula One Licensing BV. Driver names and likenesses are the property of their respective owners. The App uses publicly available F1 data for fantasy gameplay purposes.
You may not copy, modify, distribute, or create derivative works of the App.
9. Third-Party Services
The App integrates with third-party services including Google Firebase, Google Generative AI, OpenF1 API, and Expo. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or content of third-party services.
10. No Warranty
The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components. Fantasy points, prices, and scoring are calculated automatically and may occasionally contain errors, which we will endeavor to correct.
11. Limitation of Liability
To the maximum extent permitted by applicable law, The Undercut and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of enjoyment, or any other intangible losses arising from:
Your use of or inability to use the App.
Errors in scoring, pricing, or game mechanics.
Unauthorized access to your account.
Any third-party conduct or content.
12. Account Deletion
You may delete your account at any time through the App's settings. Upon deletion:
Your profile and personal data will be permanently removed from our servers.
Your team data and league memberships will be removed.
This action cannot be undone.
13. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.
14. Changes to These Terms
We may modify these Terms at any time. Updated Terms will be posted on this page with a new effective date. Your continued use of the App after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in the appropriate courts.
